
Commercial rentals in Corona times
Can tenants reduce the rent due to the limited usability of business premises or are they exempt from the rent? Can tenants terminate the lease contract prematurely?
COVID-19 measures laws and the regulations issued on their basis prohibit access to the customer area of certain branches of trade, service companies, leisure and sports businesses and restaurants. The only exceptions are certain areas such as grocery, pharmacies, banks, post offices, etc.

Root canal treatment with unpleasant consequences for both the patient and the dentist
In a recent decision the Austrian Supreme Court explained the scope of the obligation to provide medical information in detail by the example of a (simple) root canal treatment by a dentist (OGH 1 Ob 199/19z).

Stricter anti-money laundering regulations since January 2020
The 5th EU Money Laundering Directive was implemented in Austria through the 2019 EU Financial Adjustment Act. With the corresponding changes in the Financial Market Money Laundering Act (FM-GwG) and in the Economic Ownership Register Act (WiEReG), the regulations to combat money laundering in Austria have been tightened .
While numerous provisions are in force since January 10, 2020, further innovations will follow on November 10, 2020.

Davon ausgenommen sind lediglich bestimmte Bereiche wie unter anderem der Lebensmittelhandel, Apotheken, Banken, Post, etc.

You have paid a fee for the consent of the landlord to pass on your lease contract? You may be able to request that back - even after you have passed on the tenancy!
Caution is advised in the case of agreements between the landlord and the tenant in which the landlord claims consideration in return for consenting to the passing on of the tenancy because this may be a prohibited transfer within the meaning of Section 27 (1) of the Austrian Tenancy Law (MRG).
We successfully enforced the reimbursement of the paid fee for passing on the lease contract in proceedings at the Austrian Supreme Court (OGH 5Ob44 / 19k).
